What National Clinical Psychology Service does

National Clinical Psychology Service provides a referral and coordination service.

We use the information you give us to help identify and introduce you to a potentially suitable independent Clinical Psychologist.

We may:

• discuss briefly what type of help you are looking for;

• check which psychologists may have relevant experience and availability;

• consider relevant information or reports you provide for referral purposes; and

• help arrange initial contact with a psychologist.

Any initial discussion with National Clinical Psychology Service is for referral and coordination purposes. It is not a psychological assessment, diagnosis or treatment.

What National Clinical Psychology Service does not do

As part of the referral service, National Clinical Psychology Service does not provide:

• psychological assessment;

• diagnosis;

• therapy or treatment; or

• rehabilitation.

National Clinical Psychology Service does not direct, supervise or control the clinical work of the independent Clinical Psychologists to whom referrals are made.

Who provides your psychological care

If an independent Clinical Psychologist accepts your referral:

• any assessment, therapy, psychological opinion or report is provided by that psychologist;

• the psychologist is responsible for their own professional and clinical decisions; and

• any agreement for psychological services is between you and that psychologist.

The psychologist will normally provide you with their own terms and conditions, privacy information and fee information.

Referral fees and charges

National Clinical Psychology Service does not normally charge individual self-referring clients for its standard referral and coordination service.

Independent Clinical Psychologists introduced through National Clinical Psychology Service may pay NCPS a referral commission or referral fee when a referral is introduced and accepted. This is paid by the psychologist and does not affect their professional independence.

You pay the independent Clinical Psychologist for any psychological services they provide, in accordance with their own terms and fees.

If National Clinical Psychology Service proposes any separate charge for unusually extensive administrative or document-review work, this will be explained and agreed with you before the work is undertaken.

Your choice

You are free to decide whether you wish to proceed with a referral.

You can ask National Clinical Psychology Service to stop progressing the referral at any time before the introduction is completed, without penalty.

Even after an introduction has been made, you remain free to decide whether or not to proceed with the psychologist.

Your information and privacy

National Clinical Psychology Service uses personal information for referral and coordination purposes in accordance with the National Clinical Psychology Service Privacy Policy.

For an initial availability or suitability enquiry, we may where practicable give a psychologist only limited, non-identifying information.

Your identifiable contact details and referral information will normally only be passed to an independent Clinical Psychologist when you have agreed that the referral should progress.

Information may also be used or shared where this is otherwise lawful and necessary, for example because of safeguarding, serious risk or a legal obligation.

National Clinical Psychology Service is responsible for the referral information it holds. An independent Clinical Psychologist is separately responsible for the clinical information and records they hold about you.

When these Referral Terms apply

The Referral Terms apply once they have been provided or made reasonably available to you and you ask National Clinical Psychology Service to take steps to progress your enquiry or referral.

Making an initial enquiry does not oblige you to proceed with a referral.

If your concern relates to assessment, therapy, a report or other psychological services provided by an independent Clinical Psychologist, you should normally raise it with that psychologist.

Important legal point

NCPS will use reasonable care and skill in providing its referral and coordination service.

However, National Clinical Psychology Service cannot guarantee that:

• a particular psychologist will be available;

• a psychologist will accept your referral;

• psychological services will be offered; or

• any particular clinical outcome will result.

Independent Clinical Psychologists are responsible for their own professional and clinical work.

Nothing in the Referral Contract affects your statutory consumer rights.

Important notice

National Clinical Psychology Service provides a referral and coordination service only. Psychological services, if offered, are provided by independent HCPC-registered Clinical Psychologists in private practice under their own terms and conditions.

1. Definitions

1.1 Enquirer

The individual who contacts National Clinical Psychology Service, whether seeking services for themselves or making an enquiry on behalf of another person.

1.2 Prospective Client

The person for whom Psychological Services are being sought. The Enquirer and Prospective Client may be the same person.

1.3 National Clinical Psychology Service / Dr Jurai Darongkamas

A referral and coordination service operated by Dr Jurai Darongkamas, Consultant Clinical Psychologist, which connects enquirers with independent HCPC-registered Clinical Psychologists in private practice.

1.4 Independent Clinical Psychologist

A self-employed, HCPC-registered Clinical Psychologist who is responsible for their own clinical practice, professional indemnity insurance, professional decisions and terms and conditions of service.

1.5 Psychological Services

Services provided by an independent Clinical Psychologist, which may include psychological assessment, diagnostic opinion where within the psychologist’s professional competence, therapy, rehabilitation, consultation and report preparation, including medico-legal work.

2. Nature of National Clinical Psychology Service Services

2.1

National Clinical Psychology Service provides a referral and coordination service only.

2.2

National Clinical Psychology Service:

• does not itself provide psychological assessment, diagnosis, treatment, therapy or rehabilitation as part of the referral service;
• does not supervise, direct or control the clinical work of independent Clinical Psychologists;
• does not act as the Prospective Client’s clinician or advocate; and
• is not responsible for clinical decisions made by an independent Clinical Psychologist or for the availability of any particular psychologist.

Any initial telephone discussion, email exchange or review of information by National Clinical Psychology Service is undertaken for referral and coordination purposes and does not constitute psychological assessment, diagnosis or treatment.

2.3

Independent Clinical Psychologists may pay National Clinical Psychology Service a commission or referral fee when a referral is introduced and accepted. This arrangement does not affect the psychologist’s professional independence or the Prospective Client’s freedom to decide whether to proceed.

2.4 No guarantee

National Clinical Psychology Service does not guarantee that a referral will result in an appointment, ongoing Psychological Services or any particular clinical or other outcome.

3. Subject Matter of the Agreement

3.1

National Clinical Psychology Service will use reasonable care and skill to facilitate an introduction to a potentially suitable independent Clinical Psychologist, based on the information provided and the psychologists available through the service.

3.2

The decision whether to accept a referral and offer Psychological Services is made by the independent Clinical Psychologist.

3.3

Any contract for Psychological Services is between the Prospective Client and the independent Clinical Psychologist providing those services.

4. Referral Process

4.1

The Enquirer agrees to provide information that is, to the best of their knowledge, accurate and relevant to the referral.

4.2

National Clinical Psychology Service may, where appropriate:

• hold brief consultations with the Enquirer by telephone, email or other remote means for referral and coordination purposes;
• review relevant existing reports or other information for the purpose of considering referral suitability;
• prepare referral information for consideration by an independent Clinical Psychologist; and
• liaise regarding availability and initial appointment arrangements.

Any review undertaken by National Clinical Psychology Service for these purposes is not a clinical assessment or second opinion.

If an unusually extensive administrative or document review is required and a fee is proposed, this will be explained and agreed in advance.

4.3

For initial suitability or availability enquiries, National Clinical Psychology Service may where practicable provide a psychologist with limited, non-identifying information about the proposed referral.

4.4

Identifiable contact details and referral information will normally only be passed to an independent Clinical Psychologist when the Enquirer or Prospective Client has agreed that the referral should progress.

Information may also be disclosed where otherwise lawful and necessary, for example in relation to safeguarding, serious risk or a legal obligation.

4.5

The availability of any particular independent Clinical Psychologist cannot be guaranteed.

4.6

If a referral is accepted, the independent Clinical Psychologist will normally contact the Prospective Client directly and will provide their own terms and conditions, privacy information and fee information.

5. Formation and Ending of the Referral Contract

5.1

These Referral Terms apply once they have been provided or made reasonably available to the Enquirer and the Enquirer asks National Clinical Psychology Service to take steps to progress an enquiry or referral.

An initial enquiry does not oblige either the Enquirer or National Clinical Psychology Service to proceed with a referral.

5.2

The National Clinical Psychology Service referral service will ordinarily be regarded as completed when, with the appropriate agreement to proceed, the relevant referral information has been passed to the chosen independent Clinical Psychologist and the introduction has been facilitated.

Limited administrative liaison may continue afterwards where reasonably necessary to complete referral arrangements.

5.3

The Enquirer may ask National Clinical Psychology Service to stop progressing a referral at any time before the introduction is completed, without penalty.

After an introduction has been made, the Prospective Client remains free to decide whether or not to proceed with the independent Clinical Psychologist.

5.4

Nothing in this Agreement affects any statutory rights available to a consumer, including rights under the Consumer Rights Act 2015 where applicable.

6. Fees and Payments

6.1

National Clinical Psychology Service does not normally charge individual self-referring Clients for its standard referral and coordination service.

If a separate, more extensive administrative or document-review service is proposed, any charge will be explained and agreed before that work is undertaken.

6.2

Fees for Psychological Services are payable to the independent Clinical Psychologist in accordance with that psychologist’s own terms and conditions, unless another payment arrangement has expressly been agreed.

6.3

The Prospective Client is responsible for reviewing the independent Clinical Psychologist’s terms and conditions, including their fees, payment arrangements and cancellation policy, before proceeding with Psychological Services.

7. Complaints

7.1 Referral service

Feedback or complaints concerning the National Clinical Psychology Service referral and coordination process should be directed to:

Dr Jurai Darongkamas aims to provide an initial response within three working days.

7.2 Psychological Services

Concerns regarding psychological assessment, therapy, reports, clinical decisions or other Psychological Services provided by an independent Clinical Psychologist should normally be directed to that psychologist in the first instance.

7.3 Professional conduct

Concerns regarding the fitness to practise or professional conduct of Dr Jurai Darongkamas in her capacity as an HCPC-registered Practitioner Psychologist may be raised with the Health and Care Professions Council (HCPC).

Where applicable, matters relating to membership of the British Psychological Society may also fall within the Society’s complaints or conduct procedures.

8. Confidentiality and Data Protection

8.1

National Clinical Psychology Service processes personal information in accordance with its current Privacy Policy, available on the National Clinical Psychology Service website.

The Privacy Policy provides further information about the types of information National Clinical Psychology Service processes, the purposes and lawful bases for processing, how information may be shared, retention periods, security and individuals’ data-protection rights.

8.2

National Clinical Psychology Service acts as an independent data controller in relation to information it processes for referral and coordination purposes.

An independent Clinical Psychologist acts as a separate data controller in relation to the Psychological Services they provide and their associated clinical records.

8.3

Information provided during an enquiry may include personal data and special-category information such as health information. National Clinical Psychology Service will process such information only for relevant and lawful purposes as described in its Privacy Policy.

8.4

Where specific consent or explicit consent is required or relied upon for a particular disclosure or processing activity, this will be sought separately as appropriate.

Where processing relies on consent, consent may be withdrawn. Withdrawal does not affect processing lawfully undertaken before withdrawal and may, depending on the circumstances, prevent National Clinical Psychology Service from progressing or completing a referral.

8.5

National Clinical Psychology Service will share information only where relevant and proportionate to the referral or where sharing is otherwise permitted or required by law.

9. Responsibility and Limitation of Liability

9.1

National Clinical Psychology Service is responsible for carrying out its own referral and coordination service with reasonable care and skill.

9.2

National Clinical Psychology Service does not guarantee that:

• any particular independent Clinical Psychologist will be available or accept a referral;
• an introduction will result in Psychological Services being offered;
• a particular form of assessment or treatment will be recommended; or
• Psychological Services will achieve any particular outcome.

9.3

Independent Clinical Psychologists are self-employed practitioners and are responsible for their own professional and clinical acts, decisions, advice, reports and Psychological Services.

National Clinical Psychology Service is not responsible for the independent provision of those Psychological Services, except to the extent that any liability arises from NCPS’s own acts or omissions and cannot lawfully be excluded.

9.4

Nothing in this Agreement excludes or limits liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, breach of a statutory right which cannot lawfully be excluded, or any other liability which cannot lawfully be limited or excluded.

9.5

Independent Clinical Psychologists are not employees of National Clinical Psychology Service and National Clinical Psychology Service does not direct or control their independent clinical practice.

10. Standard Legal Provisions

10.1 Events outside reasonable control

Neither party will be responsible for delay or failure to perform an obligation caused by circumstances genuinely outside their reasonable control, provided reasonable steps are taken where practicable to minimise the effect of the delay.

10.2 Severability

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions will continue in effect.

10.3 Variations

Any individually agreed variation to these terms should be recorded in writing.

10.4 Entire agreement

These terms set out the basis on which National Clinical Psychology Service provides its referral and coordination service to individual Enquirers.

Nothing in this clause excludes any statutory right or any statement or information which the law requires to be treated as binding.

11. Electronic Acceptance and Governing Law

11.1

Where these Referral Terms have been provided or made reasonably available, an Enquirer who asks National Clinical Psychology Service to proceed with referral or coordination steps will be treated as accepting them.

11.2

This Agreement is governed by the law of England and Wales.

The courts of England and Wales will have jurisdiction, subject to any mandatory rights a consumer may have under applicable law to bring proceedings in another court with jurisdiction.
